Natura juridică a sancţiunii

Abstract

The sanctions, under the form of specific measures of legal constraint that affect the offender’s mind and will, are measures that restore and maintain the law order. The study of the sanction problem extends our horizon about the importance of this legal institution, the correlation of the sanction with the social responsability phenomenon, the legal norms’ impact on the behavior held by the members of our society. However, if we take into consideration that the sanction provides the constraint forms and measures, forecasted in the structure of the rule of law, it means that the purpose of the sanction is meant to assure the legal norm compliance by everyone.

Sancţiunile, sub formă de măsuri specifice de constrîngere juridică, care afectează mintea şi voinţa infractorului, sunt măsuri care refac şi menţin ordinea de drept. Studiul problemei sancţiunilor, extinde orizontul nostru cu privire la importanta acestei instituţii juridice, la corelaţia sancţiunii cu fenomenul responsabilităţii sociale, la impactul normelor juridice asupra comportamentului desfăşurat de membri societăţii. Cu toate acestea, daca luăm în consideraţie că sancţiunea prevede formele şi măsurile de constrîngere, prevăzute în structura normei de drept, înseamnă că scopul sancţiunii este menit spre asigurarea respectării de către toţi a normei juridice.
