Evoluția conceptului de expropriere pentru cauză de utilitate publică și reglementarea exproprierii în dreptul comparat

Abstract

Prezenta cercetare analizează evoluția instituției juridice a exproprierii pentru cauză de utilitate publică, exproprierile atipice care au fost urmarea unor conjuncturi istorice pe plan național și european. Vom cerceta evoluția exproprierii în Republica Moldova, în spațiul românesc în unele state europene și în unele state ex-sovietice. Demersul nostru este orientat și spre dreptul comparat, în special spre sistemul juridic francez, unde această instituție apare pentru prima oară în formă modernă odată cu Revoluția franceză, dar și către conceptele filosofice de contract social și stat de drept, care creează cadrul obligativității acceptării unei astfel de limitări a dreptului de proprietate privată, și contextul istoric în care ele au apărut. Apreciem că analiza comparativă a celor două sisteme juridice în ceea ce privește exproprierea și prezentarea punctelor de diferențiere pot pune și mai bine în lumină fundamentele exproprierii, punctele fragile și soluțiile adecvate pentru remedierea acestora.

This research analyzes the evolution of the legal institution of expropriation for reasons of public utility, atypical expropriations that were the result of historical circumstances at national and European level. We will investigate the evolution of expropriation in the Republic of Moldova, in the Romanian space in some European states and in some ex-Soviet states. Our approach is also oriented towards comparative law, especially towards the French legal system, where this institution appears for the first time in modern form with the French Revolution, but also towards the philosophical concepts of social contract and rule of law, which creates the obligation to accept a such limitations on private property rights, and the historical context in which they arose. We appreciate that the comparative analysis of the two legal systems regarding the expropriation and the presentation of the differentiation points can shed even better light on the foundations of the expropriation, the fragile points and the appropriate solutions to remedy them.
