Raportul dintre răspunderea patrimonială în dreptul civil şi răspunderea materială în dreptul muncii

Abstract

În cadrul analizei teoretice a răspunderii patrimoniale în dreptul civil şi a răspunderii materiale în dreptul muncii, sînt stabilite locul şi importanţa acestor forme ale răspunderii juridice. Autorul face o analiză comparativă a condiţiilor survenirii răspunderii materiale în dreptul muncii şi a răspunderii patrimoniale în dreptul civil, în ceea ce priveşte realizarea funcţiei reparatorii a răspunderii juridice. In the theoretical analysis of patrimonial liability in civil law and material liability in labor law are established place and the importance of these forms of legal responsibility. The author made a comparative analysis of the supervene conditions and realization of material liability in labor law and patrimonial liability in civil law in terms of achieving restorative function of legal liability.
