Aplicarea managementului facilităților în cadrul Legii condominiului

Abstract

Obiectivele principale urmărite în procesul de elaborare fiind accentuarea importanței integrării serviciilor de management al facilității în cadrul administrării clădirilor, prin intermediul Legii condominiului, astfel încurajându-se dezvoltarea acestui domeniu pe piața Republicii Moldova. Lucrarea în sine este constituită din 3 compartimente de bază: particularitățile Legii condominiului, studiu comparativ a proiectelor de lege a condominiului și managementul facilităților. Aceste compartimente fiind interdependente oferă o imagine complexă a direcției de dezvoltare a cadrului legislativ în vederea optimizării operațiunilor de administrare a fondului locativ care urmărește excluderea lacunelor legii. Acesta constituind un punct de bază în motivarea companiilor de a activa pe teritoriul Republicii Moldova. În primul capitol sunt prezentate evenimentele istorice care au condiționat apariția și necesitatea legii condominiului, prevederile actuale a Legii nr. 913/2000 condominiului în vederea activității asociațiilor în condominiu și disfuncționalitățile gestionarii fondului locativ conform legii. În cel de-al doilea capitol este reprezentat un studiu comparativ a Legii actuale nr. 913/2000 și Legii nr. 276/2018 (lege în faza de reexaminare) cu privire la condominiu. Studiul urmărește posibilitatea rezolvării lacunelor existente și analiza eficienței Legii noi. În cadrul celui de al treilea capitol este descris contextul dezvoltării domeniului managementului facilităților la nivel global și impacul acestuia. Domeniul de aplicabilitate în Republica Moldova și serviciile prestate în acest domeniu, dar și tendințele de dezvoltare a acestui domeniu în contextul pandemiei COVID-19. Subiectul este actual, deoarece abordează aplicabilitatea managementului facilităților – domeniu slab dezvoltat la noi pe piață, dar care este promițător din punct de vedere a sustenabilității și oferirii serviciilor de calitate. Descriind necesitatea de aplicare a MF în cadrul asociațiilor de gestionare a proprietății comune, luându-se în calcul starea agravată a fondului locativ din țară.

The main objectives pursued in the elaboration process are to emphasize the importance of integrating services of the facilities management within the building administration through the Condominium Law. Thus encouraging the development of this field on the market of the Republic of Moldova. The work is build up from 3 basic compartments: specific features of the condominium law, a comparative study of the condominium draft laws and the facilities management. These interdependent compartments provide a complex picture of the direction of development of the legislative framework in order to optimize operations of the housing fund administration that seeks to exclude the law gaps. This represent the base point in motivating businesses to establish a presence in Moldova. In the first chapter are represented the historical events that conditioned the appearance and necessity of the condominium law, the current regulations of Law no. 913/2000 in view of the activity of the condominium associations and the dysfunctions of building fund management according to the law. The second chapter compares the current condominium law, Law No. 913/2000 and Law No. 276/2018 (law awaiting re-examination). The study seeks to address existing gaps and analyze the effectiveness of the new law in the context of today's society potential. The third chapter describes the development context of the global facilities management field and its impact. Also the applicability of field in the Republic of Moldova and the services provided in this domain, and the development trends of this field in the context of the COVID-19 pandemic. The theme of work is up-to-date because it addresses the applicability of facility management - a field that is poorly developed in our market, market but has great potential in terms of sustainability and high-quality services. Describing the need of application the MF within joint property management associations, taking into account the bad conditions of the housing development in the country.
