This summary analyzes the legal status of the surviving spouse under the inheritance law of the Republic of Moldova, highlighting the conditions necessary for acquiring the right to inherit and the historical evolution of this institution. The status of spouse at the time of the opening of the succession is the essential prerequisite for inheritance, being excluded in the absence of a valid marriage or in the event of its dissolution or nullity. Cohabitation does not produce succession effects, as it is not legally recognized. The paper emphasizes that acquiring the status of heir requires the cumulative fulfillment of the capacity to inherit, the right to inherit, and the absence of disqualification. At the same time, it analyzes the historical evolution of the surviving spouse’s position, from an uncertain status under customary law to a modern, clear, and protective legal framework. Under current law, the surviving spouse enjoys both general and special inheritance rights, including the right to inherit the estate as a first-class heir alongside the deceased’s descendants, as well as rights to household goods and the family home. These regulations reflect the need to protect the surviving spouse’s financial and social interests, ensuring a distinct and balanced legal position within the succession process.
