Ordinea juridică în raport cu normele juridice

Abstract

The ordinate and coherent character of the concept in its intimacy is given by the finding and assuring some logical requirements of the construction and validity of the norms. The juridical order rules both the significant social behaviors from the juridical point of view of the individuals and the diversity of the considered juridical relations between the diverse institutional subsystems of the state, between the diverse subsystems of the considered global society. In the Kelsian way, the juridical order is correlated with the concepts of rule of law and state law, without the existence of an identity of contain of those three concepts. The juridical order is au equipotent concept in relation with the concept of normative order. On the other hand, the juridical order is the normative stratum that sustain and legitimizes the rule of law. Also, were underline that the juridical order is a concept which contain three directions: the national juridical order, the communitarian juridical order and the international juridical order.
