Aplicarea și executarea pedepsei privative de libertate față de minori în legislația altor state

Abstract

Pentru formarea unei viziuni cât mai ample asupra instituției pedepsei privative de libertate față de minori precum și a elucidării aspectelor pozitive și negative ale legislaţiei naţionale în comparaţie cu legislaţiile penale ale altor state referitoare la capitolul respectiv, ne-am propus studiul cadrului legislativ a statelor: Franței, Germaniei, Olandei, Poloniei, Elveției, ș.a. Articolul își propuneca scop cercetarea multilaterală a instituției pedepsei privative de libertate față de minori prin prizma legislației mai multor state. Actualitatea și scopul articolului derivă și în cercetarea practicii judiciare privind pedepsa privativă de libertate față de minori, în special a Franței, Germaniei, Olandei, Poloniei, Elveției, ș.a. Rezultatele cercetării prezentului studiu pot servi drept bază pentru elaborarea unor recomandări și acțiuni practice în vederea îmbunătățirii nivelului de reglementare și aplicare a pedepsei privative de libertate față de minori în legislația națională, pot constitui material util atît pentru instituțiile statului cît și pentru instanțele judecătorești.

To shape the widest possible view of the institution of the custodial sentence against minors and to circumvent the positive and negative aspects of national legislation compared to the criminal legislation of other States regarding that chapter, we proposed to study the legislative framework of the States: France, Germany, the Netherlands, Poland, Switzerland and the other The Article aims to multilateral research into the institution of the custodial sentence against minors by means of the legislation of several States. The timeliness and purpose of the Article also derives from the investigation of the judicial practice concerning the freedom to minors from the punishment, in particular from France, Germany, the Netherlands, Poland, Switzerland and others The results of the research in this study may serve as a basis for the development of recommendations and practical actions to improve the level of Regulation and application of the custodial sentence to minors in national law, and may be useful material for both the state institutions and the courts.
