Abstract

Actualitatea subiectului rezidă din interesul manifestat pentru identificarea formelor răspunderii juridice care sînt chemate să evolueze odată cu societate şi deasemenea importanţa răspunderii patrimonială ca formă a răspunderii juridice, interes generat de continua reconfigurare a realităţii sociale, care implică reevaluarea unor fenomene juridice. Doctrina şi legislaţia juridică a acordat întotdeauna o importanţă deosebită răspunderii juridice şi mai ales răspunderii pentru încălcarea dreptului de proprietate. Dreptul de proprietate fiind unul dintre cele mai importante drepturi civile patrimoniale a benificiat de o protecţie mai deosebită din partea statului. Identificarea răspunderii patrimoniale a generat un interes în literatura juridică în ultimul timp. Identificarea corectă a formelor răspunderii juridice constituie o garanţie a legalităţii angajării răspunderii juridice, contribuind totodată la eliminarea greşelilor în aplicarea normelor juridice.

The topicality of the subject results from interest pronounced to the identification of the forms of legal liability intended to evolve with the society as well as the importance of patrimony liability as a form of legal liability, interest generated by the continuing reconfiguration of social reality, which involves the reevaluation of legal phenomenon. The legal doctrine and legislation always gave particular importance to legal liability and especially to liability for violation of patrimony right. The patrimony right being the one of the most important civil right of patrimony has beneficiated of a special protection from the state. The identification of patrimony liability generated an interest in legal literature in recent times. The proper identification of the forms of legal liability constitutes a guarantee of legality of employment of the legal liability, contributing at the same time to the elimination of errors in the application of legal norms.
