Modificări legislative privind violența împotriva femeilor și violența în familie: Jurisprudență relevantă și lacune în practica judiciară

Abstract

Prevenirea şi combaterea violenţei în familie, ca element al politicii naţionale de ocrotire şi sprijinire a familiei, reprezintă o preocupare majoră a Guvernului Republicii Moldova. Prin adoptarea legii-cadru cu privire la prevenirea şi combaterea violenţei în familie s-a făcut un pas important în crearea mecanismului instituţional și operaţional de soluţionare a cazurilor de violenţă în familie, marcând asumarea şi implementarea de către Republica Moldova a angajamentelor internaţionale de respectare a drepturilor omului. Scopul studiului este de a analiza modificările reglementărilor privind violenţa împotriva femeilor şi violenţa în familie, de a evidenţia neajunsurile în mecanismul de aplicare a acestor reglementări cu propunerea anumitor soluții.

The prevention and combating of family violence, as an element of the national policy of protecting and supporting the family, represents a major concern of the Government of the Republic of Moldova. Through the adoption of the framework law on the prevention and combating of family violence, an important step was taken in the creation of the institutional and operational mechanism for solving cases of family violence, marking the assumption and implementation by the Republic of Moldova of international commitments to respect human rights. The purpose of the study is to analyze the changes in regulations regarding violence against women and domestic violence, to highlight the shortcomings in the mechanism for applying these regulations and to propose certain solutions.
