Abstract

Цель работы: исследование и анализ теоретических и практических аспектов делегирования и формирования объектов недвижимости в кадастровой системе и правового учета прав собственности. Цель данной работы - изучить процедуры идентификации, разграничения и регистрации объектов недвижимости, а также проанализировать нормативно-правовую базу, регулирующую эти процессы, подчеркнув важность соблюдения правовых и технических требований. Одновременно исследование стремится подчеркнуть роль правильного разграничения объектов недвижимости в обеспечении безопасности правовых отношений, защите имущественных прав и предотвращении земельных споров. Задачи: анализ концепций и принципов разграничения и формирования объектов недвижимости, изучение применимой законодательной базы и кадастровых процедур, выявление практических проблем, возникающих в процессе регистрации объектов недвижимости, а также подчеркивание важности правильного разграничения для защиты имущественных прав и обеспечения правовой безопасности в имущественных отношениях. Структура работы: Учитывая сложность рассматриваемой темы, работа структурирована в три главы, которым предшествует введение и которая завершается выводами. В работе изложена цель работы и поставленные задачи. Глава 1 – теоретические аспекты определения границ и регистрации объектов недвижимости. Глава 2– представляет технологию выполнения работ. Глава 3 - Пример из практики, прикладные исследования в области определения границ и регистрации объектов недвижимости.

Scopul lucrării: constă în cercetarea și analiza aspectelor teoretice și practice privind delimitarea și formarea bunurilor imobile în cadrul sistemului cadastral și al evidenței juridice a proprietăților. Lucrarea urmărește examinarea procedurilor de identificare, delimitare și înregistrare a bunurilor imobile, precum și analiza cadrului normativ care reglementează aceste procese, evidențiind importanța respectării cerințelor legale și tehnice. Totodată, cercetarea are drept obiectiv evidențierea rolului delimitării corecte a bunurilor imobile în asigurarea securității raporturilor juridice, protecției dreptului de proprietate și prevenirii litigiilor funciare. Obiectivele cuprind: analiza noțiunilor și principiilor privind delimitarea și formarea bunurilor imobile, examinarea cadrului legislativ și a procedurilor cadastrale aplicabile, identificarea problemelor practice întâlnite în procesul de înregistrare a imobilelor, precum și evidențierea importanței delimitării corecte pentru protecția dreptului de proprietate și asigurarea securității juridice a raporturilor patrimoniale. Structura lucrării: Având în vedere complexitatea temei abordate, lucrarea este structurată în trei capitole, precedate de o introducere și finalizate cu concluzii. În cadrul acesteia sunt prezentate scopul lucrării și sarcinile propuse pentru atingerea acestuia. Capitolul 1 - aspectele teoretice privind delimitării și înregistrării bunurilor imobile. Capitolul 2 – este prezentată tehnologia executării lucrărilor. Capitolul 3 –studiu de caz, cercetări aplicative privind delimitarea și înregistrarea bunurilor imobile.

Purpose of the Work: it consists of the research and analysis of theoretical and practical aspects regarding the delimitation and formation of real estate properties within the cadastral system and the legal record of property rights. The paper aims to examine the procedures for identifying, delimiting, and registering real estate properties, as well as to analyze the regulatory framework governing these processes, highlighting the importance of complying with legal and technical requirements. At the same time, the research seeks to emphasize the role of the correct delimitation of real estate properties in ensuring the security of legal relations, the protection of property rights, and the prevention of land disputes. Objectives:the analysis of the concepts and principles regarding the delimitation and formation of real estate properties, the examination of the applicable legislative framework and cadastral procedures, the identification of practical issues encountered in the process of registering real estate properties, as well as the highlighting of the importance of correct delimitation for the protection of property rights and the assurance of legal security in patrimonial relations. Structure of the Work: Given the complexity of the subject addressed, the thesis is structured into three chapters, preceded by an introduction and concluded with the conclusions. The thesis presents the aim of the work and the tasks set to achieve it. Chapter 1 – theoretical aspects regarding the delimitation and registration of real estate properties. Chapter 2 - presents the execution technology of the works. Chapter 3 - case study, applied research regarding the delimitation and registration of real estate properties.
