Inventarierea tehnică primară a construcțiilor și corectarea erorilor cadastrale ale terenului

Abstract

Prezenta teză de licență are ca scop examinarea lucrărilor cadastrale necesare pentru inventarierea tehnică primară a construcțiilor și corectarea erorilor cadastrale ale terenului. În lucrare se evidențiază importanța datelor cadastrale corecte, a măsurărilor pe teren și a documentației tehnice în reflectarea reală a bunului imobil în Registrul bunurilor imobile. Studiul de caz se bazează pe un teren situat în satul Măgdăcești, raionul Criuleni, pe care sunt amplasate o casă de locuit, o anexă și construcții auxiliare. Teza de licență conține 76 pagini, fiind formată din introducere, trei capitole, 32 figuri, concluzii și 26 surse bibliografice. Introducerea cuprinde actualitatea temei, scopul lucrării, obiectivele principale, metodele aplicate și importanța practică a cercetării. În primul capitol sunt prezentate aspectele teoretice privind cadastrul bunurilor imobile, terenul și construcțiile ca obiecte ale evidenței cadastrale, precum și necesitatea identificării și corectării erorilor cadastrale. Capitolul doi descrie baza normativă și metodologică a lucrărilor cadastrale. Sunt analizate actele normative utilizate, etapele lucrărilor pe teren, prelucrarea camerală a datelor, folosirea echipamentelor de măsurare și a programelor specializate pentru întocmirea materialelor grafice și tehnice. Al treilea capitol reprezintă partea practică a lucrării. În cadrul acestuia sunt analizate datele inițiale ale obiectului, executarea măsurărilor, construirea conturului real al terenului, identificarea surplusului de teren și a suprapunerii, precum și inventarierea construcțiilor amplasate pe teren. De asemenea, sunt prezentate documentele întocmite pentru explicarea situației cadastrale, stabilirea caracteristicilor tehnice ale construcțiilor și continuarea procedurilor de perfectare cadastrală și juridică. Metodele aplicate au inclus analiza documentară, comparația datelor cadastrale cu situația din teren, măsurările directe și reprezentarea grafică a rezultatelor. În concluzie, se poate afirma că lucrarea demonstrează legătura directă dintre măsurările cadastrale, analiza documentelor și întocmirea corectă a materialelor finale. Rezultatele obținute permit o descriere mai exactă a terenului și construcțiilor, contribuind la actualizarea informației cadastrale, la înlăturarea neconcordanțelor identificate și la protejarea drepturilor asupra bunului imobil.

This bachelor thesis aims to examine the cadastral works required for the primary technical inventory of constructions and the correction of cadastral errors of a land plot. The thesis highlights the importance of accurate cadastral data, field measurements and technical documentation in the correct representation of immovable property in the Real Estate Register. The case study is based on a land plot located in the village of Măgdăcești, Criuleni district, on which a residential house, an annex and auxiliary constructions are located. The bachelor thesis contains 76 pages and consists of an introduction, three chapters, 32 figures, conclusions and 26 bibliographic sources. The introduction presents the relevance of the chosen topic, the aim of the thesis, the main objectives, the applied methods and the practical importance of the research. The first chapter presents the theoretical aspects of the real estate cadastre, the land plot and constructions as objects of cadastral records, as well as the need to identify and correct cadastral errors. The second chapter describes the normative and methodological basis of cadastral works. It analyses the normative acts used, the stages of field works, office data processing, the use of measuring equipment and specialised software for preparing graphic and technical materials. The third chapter represents the practical part of the thesis. It analyses the initial data of the object, the execution of measurements, the construction of the actual contour of the land plot, the identification of land surplus and overlap, as well as the inventory of the constructions located on the land plot. The chapter also presents the documents prepared for explaining the cadastral situation, establishing the technical characteristics of the constructions and continuing the cadastral and legal registration procedures. The applied methods included document analysis, comparison of cadastral data with the situation on site, direct measurements and graphic representation of the results. In conclusion, it can be stated that the thesis demonstrates the direct connection between cadastral measurements, document analysis and the correct preparation of final materials. The obtained results allow a more accurate description of the land plot and constructions, contributing to the updating of cadastral information, the elimination of identified inconsistencies and the protection of rights over the immovable property.

Настоящая дипломная работа направлена на рассмотрение кадастровых работ, необходимых для проведения первичной технической инвентаризации строений и исправления кадастровых ошибок земельного участка. В работе подчеркивается значение достоверных кадастровых данных, полевых измерений и технической документации для правильного отражения фактического состояния объекта недвижимого имущества в Реестре недвижимого имущества. Практическое исследование основано на земельном участке, расположенном в селе Мэгдэчешть Криулянского района, на котором размещены жилой дом, пристройка и вспомогательные строения. Дипломная работа содержит 76 страниц и состоит из введения, трех глав, 32 рисунков, заключения и 26 библиографических источников. Во введении раскрываются актуальность темы, цель работы, основные задачи, применяемые методы, а также практическое значение исследования. В первой главе представлены теоретические аспекты, касающиеся кадастра недвижимого имущества, земельного участка и строений как объектов кадастрового учета, а также необходимость выявления и исправления кадастровых ошибок. Во второй главе описывается нормативная и методологическая база кадастровых работ. Рассматриваются использованные нормативные акты, этапы выполнения полевых работ, камеральная обработка данных, применение измерительного оборудования и специализированных программ для подготовки графических и технических материалов. Третья глава представляет практическую часть работы. В ней анализируются исходные данные объекта, выполнение измерений, построение фактического контура земельного участка, выявление излишка земельной площади и наложения, а также инвентаризация строений, расположенных на земельном участке. Кроме того, представлены документы, составленные для разъяснения кадастровой ситуации, установления технических характеристик строений и продолжения процедур кадастрового и юридического оформления. Примененные методы включали документальный анализ, сопоставление кадастровых данных с фактической ситуацией на местности, непосредственные измерения и графическое отображение полученных результатов. В заключение можно отметить, что работа демонстрирует прямую связь между кадастровыми измерениями, анализом документов и правильным составлением итоговых материалов. Полученные результаты позволяют устранять выявленные несоответствия и защиту прав на объект недвижимого имущества.
