<link>https://repository.utm.md/handle/5014/37631</link>
According to paragraph (3) of Article 2178 of the Civil Code of the Republic of Moldova, the place of a descendant who has died at the time of the opening of the succession is taken by that descendant’s descendants. In legal doctrine, succession by representation has been defined as a benefit established by law whereby one or more legal heirs of a more distant degree, designated as representatives, ascend to the degree, place, and rights of their ascendant, designated as the represented party, who is deceased at the time of the opening of the succession, in order to receive the share of the inheritance that would have been due to the represented person had they still been alive. The utility of the institution of succession representation lies in avoiding possible inequitable consequences of the principle of proximity of kinship. Thus, for example, a grandchild of the deceased (a second-degree relative) may receive a share of the estate alongside the deceased’s living children (first-degree relatives), if their ascendant (the deceased’s child) is not alive at the time of the opening of the succession.

<link>https://repository.utm.md/handle/5014/37630</link>
The complaint is the procedural document that initiates civil proceedings and gives effect to the right of access to justice within the civil procedure of the Republic of Moldova. The court is seized exclusively through such a complaint, filed by the interested party, which reflects the principle of the availability of civil proceedings. It constitutes both an act of bringing the matter before the court and a dispositive act of the plaintiff, establishing the subject matter, basis, and scope of the proceedings. The complaint is a written procedural document, drafted in accordance with civil procedural law, through which the plaintiff brings a civil claim before the court. In other words, the complaint constitutes the first document in a series of procedural documents and forms through which the civil action is initiated and pursued until its complete conclusion. The regulation is established by the provisions of Articles 166–170 of the Civil Procedure Code of the Republic of Moldova, which set forth both the formal and substantive requirements, as well as the legal regime governing its acceptance, return, or rejection.

<title>Declararea judecătorească a dispariției și a decesului persoanei fizice</title>

<description>Declararea judecătorească a dispariției și a decesului persoanei fizice
Printr-o abordare doctrinară și practică, studiul subliniază importanța echilibrului între protecția intereselor persoanei dispărute și necesitatea stabilității circuitului civil.; The institution of declaring a person missing and legally deceased constitutes a fundamental legal mechanism for ensuring certainty in civil relationships when an individual’s existence can no longer be confirmed. This research examines the legal conditions, procedures, and consequences of declaring a person missing, as well as the transition to the declaration of death by court decision. It analyzes statutory time limits, the role of the judiciary, and the evidentiary standards required to establish the presumption of death. The study also highlights the legal effects on the individual’s property, family relations, and the status of heirs. Special attention is given to cases where the missing person reappears, assessing the implications for legal acts concluded during their absence. Through both doctrinal and practical perspectives, the paper emphasizes the need to balance the protection of the missing person’s rights with the stability of civil legal transactions.

<link>https://repository.utm.md/handle/5014/37628</link>
Prezentul studiu analizează utilizarea dronelor armate în conflictul din Ucraina (2022 - prezent ) și implicațiile concrete asupra principiului distincției, evidențiind atât oportunitățile de precizie sporită oferite de tehnologie, cât și riscurile reale de încălcare generate de atacurile nediscriminate asupra infrastructurii civile și a zonelor urbane.; The armed conflict in Ukraine has shown how the rapid change in means and methods of warfare through the massive use of armed drones creates major challenges for the provisions of international humanitarian law. From a legal perspective, any weapon used in war must meet the fundamental criterion of the principle of distinction: to allow a clear and effective separation between combatants and civilians, and between military objectives and civilian ones. Thus, even though armed drones are not prohibited per se and are not subject to any specific prohibition treaties, their use must strictly comply with the norms of the Law of Armed Conflict, in particular Articles 48 and 51 of Additional Protocol I to the Geneva Conventions (1977). This study analyzes the use of armed drones in the Ukraine conflict (2022 - present) and the concrete implications for the principle of distinction, highlighting both the opportunities for enhanced precision offered by the technology and the real risks of violation generated by indiscriminate attacks on civilian infrastructure and urban areas.
