Evoluția pieței funciare în Republica Moldova

Abstract

Problematica studiului. Prezentul studiu urmăreşte explicarea proceselor care au stat la baza creării pieţei funciare moldoveneşti, analiza fondului funciar şi componenţa lui, evoluţia sistemului de relaţii funciare în Republica Moldova şi perspectivele în dezvoltarea pieţei funciare. O atenţie sporită este acordată rezultatelor privatizării fondului funciar, dar şi particularităţilor şi tendinţelor relative a cadrului european şi cele din Republica Moldova. În lucrare fiind analizate: potenţialul funciar, structura fondului funciar pe categorii de terenuri, după forma organizatorico-juridică a deţinătorilor funciari, fiind analizate aspecte legale ce ţin de realizarea celor mai importante forme de transmitere a dreptului de proprietate (vânzare-cumpărare, arenda, schimbul, donaţia, moştenirea, etc.). De asemenea, sunt analizate evoluţiile curente ale pieţei funciare agricole: numărul tranzacţiilor funciare, suprafeţele terenurilor agricole şi preţurile medii a terenurilor comercializate etc. Obiective: Pentru a atinge scopul stabilit, sunt formulate următoarele obiective:

- abordarea teoretico-metodologică a dezvoltării procesului de reglementare a relațiilor funciare, în condițiile de trecere de la monopolul statului asupra proprietății funciare, la diversitatea formelor de proprietate asupra pământului; - descrierea situației actuale a relațiilor funciare, a dezvoltării lor istorice atât în spațiul Republicii Moldova cât și în alte țări în scopul elaborării și implementării unui sistem actualizat de reglementare a relațiilor funciare;

- elaborarea principiilor și identificarea criteriilor (categoriilor), care vor sta la baza reglementării cadrului legislativ național, precum și bazelor metodico-metodologice de reglementare a relațiilor funciare, în perspectiva apropiată Metode aplicate la realizarea cercetării. La studierea întregului set de probleme formulate în teză, au fost utilizate metode de analiză filosofică și juridică precum dialectica, metoda fenomenologică, precum și metoda formal-logică. O mare importanță a fost acordată utilizării metodelor științifice generale, cum ar fi analiza, sinteza, generalizarea, metoda abstractizării, metodele sistemică, comparativă, istorică, sistemică-structurală și funcțională.

Study issues. The present study aims to explain the processes behind the creation of the Moldovan land market, to analyze the land fund and its composition, the evolution of the system of land relations in the Republic of Moldova and the prospects for the development of the land market. Special attention is paid to the results of the privatization of the land fund, as well as to the peculiarities and relative trends of the European framework and those in the Republic of Moldova. The paper analyses the land potential, the structure of the land fund according to land categories, the legal and organisational form of the land owners, and the legal aspects of the most important forms of transfer of property rights (sale-purchase, lease, exchange, donation, inheritance, etc.). Current developments in the agricultural land market are also analysed: number of land transactions, areas of agricultural land and average prices of land traded, etc.

Objectives: In order to achieve the stated aim, the following objectives are formulated:

- Theoretical-methodological approach to the development of the process of regulating land relations, in conditions of transition from the state monopoly on land ownership to the diversity of forms of land ownership;

- description of the current situation of land relations, their historical development both in the Republic of Moldova and in other countries with the aim of developing and implementing an updated system of land relations regulation;

- elaboration of principles and identification of criteria (categories), which will be the basis for the regulation of the national legislative framework, as well as the methodological and methodological bases for the regulation of land relations in the near future

Methods applied to the research. In studying the whole set of problems formulated in the thesis, methods of philosophical and legal analysis such as dialectics, phenomenological method, as well as formal-logical method were used. Great importance was attached to the use of general scientific methods such as analysis, synthesis, generalisation, abstraction method, systemic, comparative, historical, system-structural and functional methods.

Concrete result obtained: As a result of the study we found important results in terms of land governance, established policy recommendations for the reform of priority areas. Even if the state of affairs in some land sectors is good, significant improvements are needed in others.
