Metode actuale de separare a bunurilor imobile

Abstract

Problema științifică soluționată constă în formarea bunurilor imobile prin modalitatea de separare a bunurilor imobile, drept rezulatat obținând două sau mai multe bunuri imobile fiindu-le atribuit un număr cadastral unic și individual, prin intermediul căruia poate fi identificat bunul imobile și proprietarii ce dețin dreptul de proprietate. Scopul și obiectivele tezei de master: Scopul principale îl reprezintă analiza multiaspectuală a metodelor prevăzute pentru formarea bunurilor imobile prin separare și cerințele ce stau la baza acestor separări, prin prisma prevederilor legislative și a cercetătorilor din domeniu. În ceea ce privește obiectivele prezentei lucrări, acestea sunt următoarele: analiza modurilor de formare a bunurilor imobile în ordine generală;analiza condițiilor esențiale pentru formarea bunurilor imobile;analiza modului de formare prin separare, ca mod distinct de creare a două sau mai multe bunuri imobile;analiza separării bunurilor imobile la nivel de teren;analiza separării bunurilor imobile la nivel de construcție;analiza separării bunurilor imobile la nivel de încăpere izolată;expunerea procedurii prevăzute pentru separarea bunurilor imobile;concluzii finale. Metodologia: Pentru analiza subiectului abordat în prezentul studiu, au fost aplicate metodele analitică, sistematică, logică și comparativă. Rezultatele: În lucrare vom analiza formarea bunurilor imobile prin separare ca mod distinct de formare, precum și procedura de înregistrare a drepturilor. Principalele concluzii:Separarea bunurilor imobile ca mod de formare a bunurilor presupune crearea a două sau mai multe bunuri și ulterior cu posibilitatea înregistrării atât a bunurilor cât și a drepturilor de proprietate a deținătorilor acestui drept, totodată fiindu-le atribuite și anumite obligațiuni expres prevăzute de legislație.

The solved scientific problem consists in the formation of real estate by the way of separation of real estate, as a result obtaining two or more real estate being assigned a unique and individual cadastral number, through which the real estate can be identified and the owners who have the right to property. Purpose and objectives of the master's thesis: The main purpose is the multiaspectual analysis of the methods provided for the formation of real estate by separation and the requirements underlying these separations, in terms of legislation and researchers in the field. Regarding the objectives of this paper, they are the following: analysis of the ways of forming real estate in general order, analysis of the essential conditions for the formation of real estate, analysis of the way of formation by separation, as a distinct way of creating two or more real estate analysis of the separation of real estate at land level, analysis of the separation of real estate at construction level, analysis of the separation of real estate at the level of an isolated room, presentation of the procedure provided for the separation of real estate, final conclusions. Methodology: For the analysis of the subject approached in the present study, the analytical, systematic, logical and comparative methods were applied. Results: In the paper we will analyze the formation of real estate by separation as a distinct way of formation, as well as the procedure for registering rights. Main conclusions: The separation of real estate as a way of forming assets involves the creation of two or more assets and subsequently with the possibility of registration of both assets and property rights of the holders of this right, while being assigned certain obligations expressly provided by legislation.
